Terms of Use Agreement

"Terms of Use", states the conditions under which you may use the Quality Personnel Web site.  Read this page carefully.  Using the Quality Personnel web site is acceptance of these Terms of Use.  If you do not accept these Terms of Use, please do not use this web site and service.  Quality Personnel may revise these Terms of Use at any time by updating this posting.  Because the Terms of Use are legally binding, please visit this posting regularly to examine them.  The terms "You" and "User" as used herein refer to all those individuals and/or entities that use this web site for any purpose.

All information prompted by the registration form or any other data requests sent by Quality Personnel or its Users is true, accurate and complete to the best of your knowledge. Any informaiton sent by You, including, but not limited to requests for services, and User experience and qualifications, must be true, accurate and complete. Furthermore, You agree to update any and all information previously submitted by you which a change in circumstances has rendered false, inaccurate or misleading. Quality Personnel reserves the right to remove your information if it is determined that any information You provided is not complete or accurate.

The Web Site may only be used for lawful purposes by individuals seeking employment, employers seeking employees, recruiters seeking candidates, and independent contractors seeking contract employment.  

The use of the Web Site for any of the following purposes is strictly prohibited by the Company... violating or attempting to violate the security of the Web Site, including, without limitation, accessing data not intended for such user or logging into a server or account which the user is not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Web Site, overloading, "flooding", "spamming", "mailbombing" or "crashing", sending unsolicited e-mail, including promotions and/or advertising of products or services, or forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability. Quality Personnel will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. You will not access or tamper with nonpublic areas of the Quality Personnel site, or postings of other users or their files without the express, written authorization of Quality Personnel.

The editorial content and graphics of the Quality Personnel Web Site, are protected under both United States and foreign copyright, trademark and other laws. All material is the property of Quality Personnel or its content suppliers or clients. You may not sell or modify the material or reproduce, display, publicly perform, distribute, or otherwise use the material in any way for any public or commercial purpose. The use of the material on any other web site or in a networked computer environment for any purpose is prohibited.  For your personal, noncommercial use, Quality Personnel authorizes you to download a single copy of the Material available to you on Quality Personnel.  Copyright, trademark, and other proprietary notices included in the original material must be retained on any copy You make of the material.  Unauthorized used of the Material may violate copyright, trademark and other laws.

You will not copy or adapt the HTML code that Quality Personnel creates to generate its pages. It is also protected by the Quality Personnel copyright.

Quality Personnel is designed as an information source for its users through the posting of data. By registering for Quality Personnel, You are thereby granting Quality Personnel the right, but not the obligation, in whole or in part, to use, reproduce, edit for form and content, transmit, disseminate, and display any such information in any manner consistent with the purpose and the privacy policy of the Quality Personnel site. Furthermore, You acknowledge that the User has expressly granted such information, once transmitted to or posted on the Quality Personnel site, without cost or condition, to Quality Personnel. Quality Personnel is not responsible for the storage, upkeep, or maintenance of user files, and it is recommended that users keep both saved and printed copies of the forms submitted to Quality Personnel.

Quality Personnel makes every effort to provide a convenient and functional service for the applicant and business communities. Quality Personnel, however, does not guarantee that the Quality Personnel site will be error free or that the Site or the server that operates it are free of viruses or other harmful components. It is the responsibility of the User to maintain backup files adequately and to update virus detection software to protect the integrity or security of your computer system. If, as a result of Your direct or indirect use of the Quality Personnel site, You determine that your property or equipment requires servicing or replacing, You hereby acknowledge that We are not responsible for any costs incurred.

In any jurisdiction where such waivers of warranties are not proscribed by law, the User uses the Quality Personnel site at his or her own risk, and all services and data are provided without express or implied warranties of any sort, including, but not limited to implied warranties of merchant, fitness for a particular use or purpose, or non-infringement. Quality Personnel furthermore does not warranty any services obtained through the use of the Quality Personnel site from another User or advertiser. Any dissatisfaction of a User's job performance or behavior is not the responsibility or fault of the Quality Personnel site and the User agrees to omit Quality Personnel, its employees, agents and directors, as a party in any litigation, which may result from such dissatisfaction. In jurisdictions where warranty waivers are proscribed,  You agree that the Terms of Use Agreement shall be enforced in its entirety, with only those waiver exclusions required by law excepted.

You agree to defend, indemnify, and hold harmless Quality Personnel, its officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, made by any third party due to or resulting from Your use of the Quality Personnel site or Your violation of this Terms of Use Agreement. 

You agree, in any jurisdiction where not proscribed by law, that neither Quality Personnel, nor any of its officers, directors, employees or agents responsible for creating, maintaining, or delivering the Quality Personnel site shall be liable for any direct or indirect damages resulting from your access, use of, or inability to access or use the Quality Personnel site. In jurisdictions where such waivers are proscribed, You agree that the Terms of Use Agreement shall be enforced in its entirety, with only those waiver exclusions required by law excepted.

It is acknowledged and accepted by the user that the only remedy against Quality Personnel, its officers, directors, employees or agents for any alleged damage caused by a performance or non-performance shall be the removal of the User's information and the termination of further use of the service. The User agrees that any dispute, which may arise from this Terms of Use Agreement , shall be settled through binding arbitration, whether based on tort, contract or other theory of law. Furthermore, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Quality Personnel site or the these terms and conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.

$100.00 is the total liability for Quality Personnel to you for all claims arising from the use of the materials.

Any failure of Quality Personnel to enforce, in part or in whole, any of the provisions herein listed shall not constitute a waiver of that provision or provisions or of the rest of these terms and conditions of membership.

Quality Personnel DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE MATERIAL WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Quality Personnel DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF OR THE RESULT OF THE USE OF THE MATERIAL IN THIS SITE IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU (AND NOT Quality Personnel) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.
